Former Augusta County Deputy to Face Three Felony Indictments
Posted: Jul 24, 2012 5:57 PM EDT Updated: Aug 07, 2012 6:35 PM EDT

A former member of the Augusta County Sheriff’s Office is accused of
taking thousands of dollars in taxpayer funds. Grand jury indictments
claim the deputy falsified time sheets dating back to early 2009.

The former deputy, 41-year-old Brian David Rose, was expected to be
served sometime Tuesday with three indictments for obtaining money by
false pretenses.   The former deputy could face up to 15 years in
prison, if he’s convicted of what Augusta County Sheriff Randy Fisher
calls betrayal of public and personal trust.

A sergeant who oversees grant money from the Virginia Department of
Motor Vehicles (DMV) was first to raise the red flag in the spring of
2010.  Fisher ordered an internal audit, then called in a state police
investigator.

Fisher says all that confirmed one of his deputies falsified time
sheets and overtime requests adding up to nearly $4,000.

“That’s taxpayer money, provided by the Augusta County Board of
Supervisors for overtime work,” he said.  “And it was also DMV grant
money that we use for DUI enforcement, seat belt enforcement.”

Deputy Brian David Rose was with the sheriff’s office for four years,
until December 2010.

Indictments from the Augusta County grand jury indicate that Rose’s
offenses may have stretched over his last two years on the job.

“It’s something that leaves a bad taste in my mouth. And I… It’s
just a betrayal of trust,” said Fisher.

He says this is the first case of alleged fraud that he can recall,
over his 40 years with the sheriff’s office.  A former sworn deputy as
a defendant means the case will have outside help.

Fisher said, “The commonwealth attorney appoints, asks for a special
prosecutor to oversee the investigation done by the state police. So
everything is totally unbiased.”

Waynesboro Commonwealth’s Attorney Charles Ajemian will prosecute the
case.   Brian David Rose is scheduled to make his first court
appearance on August 13.

Trayvon Martin, who was unarmed and on his way back from the store after buying some snacks.  I ask that your office have a special grand jury convened to determine if enough evidence exists to charge George Zimmerman with a crime.  This wasnt about Trayvon confronting Zimmerman, but Zimmerman putting his own life supposedly in danger.  He could have simply drove off or continue to follow.  He decided to ignore the police instructions.  At the very least he should be charged with something including obstruction of justice.  Zimmerman also was not watching a felony or crime taken place.  He had no jurisdiction and if police are giving citizens police powers than they should be investigated and held to the same standard as a police officer.  Zimmerman was acting within the color of the law, and the State should be held responsible and accountable.

Witnesses have come forward disputing the police claims.  It should be a outside law enforcement agency including the Florida State Police to take over the investigation as this matter has spiraled out of control.  There exists legitimate issues in dispute in regards to the current law and Zimmerman claims from third parties.  We know a Governor has limited discretion but has a lot of influence on whether a state agency instead of a local agency should be handling this matter.  Self defense is based off the fact that there exist no other alternative and that your life is in danger to take lethal action.  It is a clear distinction between a danger that exists at the time, or a danger that you walked yourself into.  The law at its very least should be amended that if you dont try to avoid confrontation where none exists and that you are a catalyst to escalating an criminal matter than a jury, judge, and prosecutor should decide and not the police department.

Also this is a example of a Judge taken it out of the police and City hand in Virginia in order to restore justice and integrity back to Norfolk.  How about other judges follow by example.

NORFOLK

A special grand jury convened for the first time Wednesday to investigate the city’s troubled Community Services Board, with a judge’s instruction to stick to the facts and avoid a “fishing expedition.”

Circuit Court Judge Charles E. Poston instructed the 11-member panel to investigate and report back to the court about any possible wrongdoing within the CSB, including the circumstances that allowed former employee Jill McGlone to be on the payroll for 12 years while she was suspended. The agency paid McGlone $320,000 during that time.

Poston questioned grand jury members Wednesday and determined that they had no conflicts and were qualified to serve.

John O. Simpson, former superintendent of Norfolk Public Schools, was chosen as jury foreman.

Poston ordered the special grand jury in a rare move last month. On Wednesday, he told the panel that it is not limited to investigating McGlone and could look into other potentially criminal activities at the mental health and welfare agency.

But he added: “You should not embark upon inquiry into merely speculative circumstances. In other words, you should not engage in what may be termed a ‘fishing expedition.’ ”

In its investigation, the special grand jury may subpoena documents and witnesses and hear testimony under oath.

Poston stressed that the work will remain secret to protect jurors from outside pressure, encourage witnesses to speak freely, and prevent witness tampering.

“You are an investigative body and do not determine in any way the guilt or innocence of any person,” Poston said.

The grand jury’s investigation has no set deadline but likely will take months to complete. The results will be in a report submitted to the court that may recommend criminal charges for prosecutors to pursue or may exonerate individuals when the panel finds no support for allegations against them, the judge said.

Prosecutors may then present the case to a regular grand jury for indictment. The special grand jury’s report and findings remain sealed unless a judge orders them open, according to state law.

The special grand jury on Wednesday also appointed veteran attorney John R. Fletcher as special counsel to aid in the investigation. Fletcher, a partner in the Norfolk firm Tavss Fletcher, specializes in personal injury and criminal defense. He graduated from the Marshall-Wythe School of Law at William and Mary in 1975.

“Oh my god!” Where in the world did they get Mitt Romney and more importantly why are people voting for him?   They probably do not know enough about him during the time in which they voted or hate can blind even the best sound mind.  I remember when people was giving Michael Vick a hard time in his participation of running a dog fighting ring.

Now, Mitt is getting a hard time and always facing the question about, “Where is Willard a.k.a Mitt Romney’s dog tied up today?”  This is a phrase used to demostrate Mitt Romney trips with the dog being placed on top of his roof on family outings.  His excuse was the dog would have felt better on the roof going at high speeds down highways, speed bumps, and rough roads instead of being inside secured safely in the car.  This is the judgment we need in Washington, D.C.   A individual that justifies stupidity with stupidity.  Critics have said that Mitt is weird and has a hard time connecting to people.  He also has a hard time connecting to serious pet lovers as well.

Michael Vick got 2 years in jail and Mitt Romney felony endangerment of a dog = no time.  I think it is too many political pundits basing justice off which political party that you participate with than on the safety of the general public.  Mitt Romney sounds like a pedophile and family child molester whois excuse of why he messed with his kids or family members was because they was safer with him.  I’m tired of Mitt Romney singing.  Singing America the Beautiful, Who let the Dog’s Out, and anything that stops and avoids the issues that are serious to the American public.  When Romney and the rest of his Republicans colleagues run out of things to say than they always go to the topic that gives any of their colleagues enthusiam with Obama being insulted in a personal attack on character.  Its like Republicans cant figure out how they would fix the economy so they just say well lets call the President radical and a left wing extremist.

President Obama receive criticism for giving a Harvard Professor a hug, but none for consoling Sept 11, 2001 families and victims. Towns and families destroyed by tornados, President Obama was there hugging and consoling those families while Republicans was determined not to help unless they saw cuts to go along with it in spending.  It was going to take spending to help those people, and those people didnt need help later.  Their lives was being destroyed right than and there.

A hard history lesson to Republicans like Mitt Romney, human beings and dogs was tied to car hoods and roofs only because the people inside of the car was uncomfortable with them being there.  The threat wasn’t on the roof, but with those that carried a rope, gasoline, guns, and other means of torture inside the car.  They was called racist, KKK, and all other types of supremacy names.  This is a fact and not some fiction that your party comes up with to re write the history that has yet to receive justice.

Also, I cant help but get back on the dog issue.  The Mormon religion allows for polygamy.  So would Mitt Romney strapped his extra wives to the hood of his car, because the wives would have felt more uncomfortable with Ann Romney inside.  Where is Mitt Romney wives tied up today?

All the Wars being created on Women, Dogs, Voting rights, welfare recipients, and more but none on corporations, banks and job creators!  “The things that make you go hum!”
